Owner of Inverness ice cream parlour spared prison after being convicted of assault

Sentence had been deferred for background reports on David Miele (30) who kicked a man in the face.

Miele of Dunrobin Grove, Inverness, was convicted after a trial.

Inverness Sheriff Court heard his victim lost consciousness after the assault at the Black Isle Hostel in Academy Street on October 22 last year.

Solicitor Ken Ferguson said Miele had two shops in Inverness and one in Aviemore.

He said he had been working 14-hour days in the run-up to the incident and he and his partner were trying to sleep but could not because of a party going on in the hostel.

“He didn’t want to to cause problems for the licence holder by calling the police, and entered the hostel reception area,” he said.

“It’s a matter of great regret what happened.

“He has learned a lesson that if such a thing should happen again he should call the police.”

The solicitor added that his client had acknowledged that the seriousness of the offence meant the court could consider custody as an appropriate disposal.

However, he asked it to consider the impact that would have on Miele’s family and business, which he said would be severe, as his client was involved in the production side of his business.

Sheriff Fleetwood ordered Miele to carry out 120 hours of unpaid work as an alternative to custody and placed him on a six-month supervision order.

He also ordered him to pay £750 compensation to his victim.
