Drink-driver banned for two years at Inverness Sheriff Court after pulling up at McDonald's drive-thru in Nairn while nearly five times the legal limit

A CUSTOMER at the drive-thru to the new McDonald's restaurant on Nairn got more than he bargained for when he stopped for a meal on Sunday evening.

David Birks was heavily intoxicated and depute fiscal Anna Chisholm said staff contacted police.

She said he was slurring his speech and kept changing his order.

Police were alerted about 10pm and attended the drive-thru within five minutes and found the 25 year-old offshore mechanic at the wheel of his car.

He was breath-tested and had nearly five times the legal limit of alcohol with a reading of 109mcgs of alcohol per 100mls of breath.

Birks, of Railway House, Drumduan, was driving a car worth £3500 and the fiscal sought forfeiture because of the high reading and a previous drink-driving related offence for being drunk in charge.

Solicitor Duncan Henderson asked the sheriff not to order forfeiture.

He said Birks doesn't drink when he is at work offshore and he earned between £3000 and £4000 a month.

Birks, who appeared from custody and pleaded guilty, accepted he acted stupidly and he had paid £7000 for the vehicle 18 months ago.

He was worried he could be facing custody.

Sheriff Chris Dickson said it was an extremely high reading.

He refuse the application for forfeiture but fined Birks £1000 and disqualified him from driving for 24 months.
