First-time offender (54) arrested for possessing offensive weapon after fetching rubber mallet to quell noisy neighbours in Inverness

Noisy neighbours prompted an Inverness man with no criminal record to fetch a rubber mallet to frighten them into making less noise.

But for 54-year-old Nicholas O’Sullivan, it was a mistake for the police were called and he was arrested for possessing an offensive weapon.

Inverness Sheriff Court heard O’Sullivan had tried to quieten down the early morning party which was being held in a block of flats in Mackintosh Road, where he lives.

Fiscal depute Naomi Duffy-Welsh said O’Sullivan confronted a group of people at about 4am who had gathered outside for a smoke to ask to them to be quieter.

He was back out again at 5.30am to make a similar plea and emerged a third time a short time later.

But he had a mallet and Ms Duffy-Welsh said: “He held it up as if he was going to strike one of them but he didn’t.

“He dropped it and went back into his flat. Police were called and he was arrested.”

Defence solicitor advocate Neil Wilson told Sheriff Gary Aitken his client, who admitted possessing an offensive weapon, was a first offender and regretted his actions.

Sheriff Aitken deferred sentence on O’Sullivan until July 7 for an opportunity to show good behaviour.
