Highland driver’s ‘foolish’ decision due to ‘flustered partner’

Police got a tip-off about a disqualified driver who was behind the wheel of a car on the Black Isle.

Officers tracked down the vehicle to Rosemarkie and stopped it to find 29-year-old Josh Kidd, of Greenside Street, Rosemarkie had been banned from driving until 2027.

Kidd appeared at Inverness Sheriff Court and admitted driving while disqualified on September 11, last year.

But Sheriff Gordon Lamont was perplexed about how to sentence Kidd as any driving ban would run along with his current disqualification and it would have little effect.

He then decided to impose six penalty points which would remain on his licence and carry out 60 hours of unpaid community work, after hearing an explanation from defence solicitor Rory Gowans.

The lawyer told the court: "His partner was driving at the time and as she was only a provisional licence holder there was also a co-driver.

“However he left the vehicle, she became flustered and he took control. It was a situation which just developed and he made a foolish decision.

"He knew it was wrong and he behaved recklessly and impulsively.”

Sheriff Lamont told Kidd: "The court treats driving while disqualified very seriously but you have been given the benefit of the doubt."
