A digger driver will be able to keep his job despite being caught drunk behind the wheel of his car.

Inverness Sheriff Court heard that Mikus Lukstins (30), of Lower Kessock Street, Inverness, would not lose his job if he lost his driving licence for having 211mg of alcohol in his system when the legal limit is 50mg.

Police found him in his vehicle in the city’s Anderson Street on October 20 last year and he tested positive for alcohol.

Defence agent John MacColl told Sheriff David Sutherland that his client had been in the UK for 13 years and had never come to the attention of police before.

Mr MacColl said: "It was an error of judgement and he shouldn't have been there. He tells me he does not require his licence to carry on his job although it will be inconvenient for him to get to and from work.

"The court can impose 10 penalty points on his licence which would mean that he can't even have a bald tyre or run a red light without losing his licence or the court could impose a discretionary period of disqualification."

Sheriff Sutherland chose to endorse Lukstins's driving licence with points and fined him £640.
