A9 drink-driver caught after police spotted him near Milton of Leys, Inverness
A company director was caught drink-driving for a second time - 15 years after he was dealt with for a similar offence when he didn't have a licence.
Inverness Sheriff Court heard that 31-year-old scaffolding boss Daniel Wemyss, of Ashwood Grove, Inverness was stopped by police who were concerned about the manner of his driving on the A9 near Milton of Leys on the evening of December 13 last year.
Fiscal depute Sophie Marshall told Sheriff Sara Matheson that officers detected the smell of alcohol from him and he had glazed eyes.
A breath test showed he had 43mcgs of alcohol when the legal limit is 22mcgs.
He admitted drink-driving and his lawyer Rory Gowans said: "He met a friend and had three or four pints. But he got a call from his partner to return home and he misjudged, thinking he was OK.
"He has a previous similar conviction but it was 15 years ago when he didn't have a licence."
Sheriff Matheson fined Wemyss £760 and disqualified him from driving for 22 months. However she certified him suitable for the drink-driver's rehabilitation course. He will get a 25 per cent discount of his ban if he successfully completes it.
